Early in May 1965, the truck was picked up and towed to the defendant's place of business in Prescott, Arizona where it was inspected, repaired, and subsequently driven away by the defendant. A letter written by the attorney for the plaintiff to the attorney for the defendant notifying him of the accident and requesting inspection, repair, and return of the truck accompanied the complaint and summons. The truck was actually returned to the plaintiff on 2 June 1965. The defendant neither was served nor had an attorney with it when the default was entered.\nThe defendant claims the entry of the default was error on the basis that its having neither an attorney nor an employee *7 present was sufficient notice of the filing of the complaint and summons.\nThe plaintiff in response argues that the judgment was taken pursuant to § 12-821, A.R.S. and that the defendant's failure to file an answer was due to the negligence of his attorney who was absent from Prescott at the time the summons and complaint were filed.\nIt is not necessary for us to pass upon the merits of this argument since § 12-821 is not applicable to this situation.
