The court said the legislation adopted by Congress in 2010, which was subsequently incorporated into U.S. law, was incompatible with the EU’s anti-discrimination rules.

\n

The case had been brought by the European Union and Iran’s financial services body Europafin against the U.S. Department of Treasury and officials within the Securities and Exchange Commission (SEC).

\n

The court said Congress had effectively banned Europafin from complying with the U.S. obligations to “refrain from engaging in conduct which threatens the economic interests of the United States, endangers the financial stability of the United States, or undermines the rule of law in the United States”.

\n

The U.S. companies were found in breach of those obligations, the judges said.

\n

As well as prohibiting financial services, the law also prohibited U.S. financial institutions from engaging in certain activities with Europafin.

\n

The law would therefore contravene the European Union’s “freedom of establishment” rights, the court said.

\n

Another ruling on a similar case in which the EU failed to win a preliminary ruling, decided last year, had resolved only one of the issues in the case but the decision was enough to put the U.S. law in breach of EU anti-discrimination rules.

\n

“The Court cannot ignore the consequences of the U.S. legislation in the field of international trade, because the international implications of that legislation could therefore impact upon EU companies’ activities,” the judges said.

\n

The challenge had been brought by Europafin in 2016 on behalf of 26 companies, including French multinational Pinault Asset Management and German company Allianz, arguing that the U.S. sanctions meant their business suffered as a result.
